The OFT (Office of Fair Trading) has recently published new guidance on debt collection, which has set the benchmark standards expected of all businesses engaging in debt recovery. The release of these guidelines follows an increase in recovery agencies acting in an unprofessional manner – contacting debtors at unreasonable times, such as when they’re in hospital or misusing Social Networking channels in order to gain access to the debtors.
The new guidelines highlight the responsibilities of all parties involved in the debt recovery process – including creditors, for the quality and level of information they maintain and exchange with others in order to avoid the wrong person being pursued for a debt. These guidelines also act to ensure that recovery agencies adopt appropriate procedures and practices for dealing with particularly vulnerable debtors.
